We have a skilled team of arbitrators and mediators. They are ready to help resolve disputes outside of court, whether it is formal or informal.

Our panel includes respected trial lawyers and retired judges from all over the country with different areas of expertise. This way, you can select a decision maker who understands your specific dispute.

Flat-Fee Mediation Services

Our ADR services include the use of Lexitas facilities and conference rooms, complimentary snacks and beverages, document handling and exchange facilitation, administrative support and more – all at a reasonable fee for each party.

Administrative Fees

$250 per party for mediations/$500 per party for arbitrations

An administrative fee may be charged for Special Master proceedings; please consult with an Lexitas administrator for details. 

Lexitas charges an upfront administrative fee when an arbitration hearing or mediation session has been scheduled. If a case settles or is withdrawn after Lexitas has confirmed a date with the parties, Lexitas will retain its administrative fee and the neutral is entitled to a minimum (2) two-hour cancellation charge and/or may bill for any time actually spent on the case. 

The upfront per party administrative fee includes coordination, conflict checks, scheduling and confirmation.

Parties attending mediation will enjoy the use of Lexitas’ facilities and state-of-the-art conference rooms, complimentary tea, soda, coffee and snacks, copying, postage and administrative support.

Courier service, express or overnight mail charges and technology services such as projectors, screens, video-conferencing or other presentation equipment needs are not covered and will be invoiced to the party requesting or incurring same. Lunch will be provided upon request and invoiced to the parties. 

Neutral Fees

Average range: $250-$600+ per hour. 

Neutrals set their own hourly rates. Their fees may include:
  • Preparation time
  • Phone or conference calls
  • The dispute resolution session(s)
  • Follow-up time
  • Any research or reading time required
Travel time, mileage, and related expenses may also be billed, depending on distance. A portion of the neutral’s hourly rate is retained by Lexitas as part of the administrative fee.

Cancellation Policy

Lexitas ADR does not charge an administrative fee if a case is withdrawn before a dispute resolution session is scheduled.

However, if a session is cancelled or withdrawn after a date is confirmed with the parties and the neutral:
  • The administrative fee will be retained.
  • The neutral is entitled to a minimum two-hour cancellation fee.
  • The neutral may also bill for any time already spent on the case.
If a scheduled case is cancelled, settled, or withdrawn within 10 business days of the confirmed session date:
  • The neutral may charge a minimum four-hour cancellation fee.
  • Additional time incurred by the neutral will also be billed, along with the administrative fee.

Payment Policy

All fees are split between the parties. 

Unless otherwise agreed, all fees and expenses are divided equally between the parties.

Lexitas ADR may request a deposit from the parties to cover expected costs, including the neutral’s compensation. Once the matter concludes, Lexitas ADR will either bill the parties or provide a final accounting if a deposit was made.

Payment is due upon receipt of the invoice or final accounting.

If the matter continues for more than 30 days beyond the initial session, Lexitas ADR may issue an interim invoice in addition to a final bill at the conclusion of the case.
